Terms & Conditions

These General Tour Terms & Conditions (“General Terms”) apply to wildlife photography tours, safaris, expeditions, workshops, and other hosted travel experiences (“Tour” or “Tours”) offered by Lindsey Arpin (“Tour Host”).


Each Tour may also be subject to separate Trip-Specific Terms & Conditions, which contain information unique to that Tour, including dates, destinations, pricing, deposit requirements, payment schedules, cancellation terms, minimum participation requirements, inclusions, exclusions, accommodations, and other Tour-specific details.


By booking a Tour or submitting payment, the Guest acknowledges that they have read, understood, and agreed to these General Terms and the applicable Trip-Specific Terms & Conditions.


If there is a conflict between these General Terms and the Trip-Specific Terms & Conditions, the Trip-Specific Terms & Conditions shall control with respect to that Tour.


The Tour Host reserves the right to update these General Terms for future bookings. The version in effect at the time of booking shall govern the Guest’s participation.


1. Booking and Payment


A reservation is not confirmed until the Tour Host has received the required deposit or other initial payment specified in the applicable Trip-Specific Terms & Conditions.


Deposit amounts and payment schedules vary by Tour and will be clearly disclosed before booking.


The remaining balance must be paid according to the deadline specified for the applicable Tour unless otherwise agreed in writing by the Tour Host.


If payment is not received when due, the Tour Host may treat the booking as canceled by the Guest, retain any amounts that are non-refundable under the applicable terms, and offer the space to another participant.


By submitting a booking or payment, the Guest acknowledges and agrees to these General Terms and the applicable Trip-Specific Terms & Conditions.


2. Pricing and Price Adjustments


Tour prices, single supplements, deposits, and other Tour-specific charges are stated in the applicable Trip-Specific Terms & Conditions.


Prices are based on costs, park fees, government fees, taxes, exchange assumptions, transportation costs, and supplier pricing in effect when the Tour is offered.


If there is a material increase in government fees, park fees, taxes, fuel surcharges, or third-party supplier costs before final payment, the Tour Host may pass through such increases to the Guest upon written notice.


If an increase imposed by the Tour Host exceeds 10% of the original Tour price, the Guest may cancel within five (5) business days after receiving notice and receive a refund of amounts paid, less any non-recoverable costs already incurred on the Guest’s behalf.


3. Payment Methods and Fees


Payments may be made through WeTravel, bank transfer, or another payment method approved by the Tour Host.


The Guest is responsible for applicable payment-processing fees, wire fees, bank charges, currency-conversion costs, intermediary fees, or similar charges unless otherwise stated.


If the Guest initiates a chargeback or payment dispute without valid basis, the Guest remains responsible for amounts legitimately due under the booking terms and any direct fees reasonably incurred by the Tour Host in responding to the dispute.


4. Tour Inclusions and Exclusions


The specific services included in each Tour are described in the applicable itinerary and Trip-Specific Terms & Conditions.


Unless expressly stated as included, Tour prices generally do not include international airfare, domestic airfare, passports, visas, vaccinations, travel insurance, medical insurance, emergency evacuation coverage, alcoholic beverages, laundry, gratuities, souvenirs, optional activities, personal expenses, or additional expenses resulting from delays or interruptions.


The Guest is responsible for reviewing the applicable Tour information before booking.


5. Passports, Visas and Travel Requirements


The Guest is solely responsible for obtaining and carrying all passports, visas, vaccination documentation, travel authorizations, permits, and other documentation necessary to enter, exit, and travel through all applicable destinations and transit countries.


The Guest is also responsible for complying with airline requirements, baggage restrictions, customs requirements, local laws, park regulations, wildlife regulations, and other applicable requirements.


The Tour Host is not responsible if a Guest is denied boarding or entry, delayed, detained, or unable to participate because the Guest lacks appropriate documentation or fails to satisfy applicable requirements.


6. Travel Insurance


Guests are strongly advised, and may be required for certain Tours, to obtain comprehensive travel insurance appropriate for the destination and activities involved.


Recommended coverage includes trip cancellation and interruption, emergency medical treatment, medical evacuation and repatriation, baggage and equipment loss or damage, and other appropriate travel-related risks.


If a particular Tour requires proof of insurance, that requirement will be disclosed in the Trip-Specific Terms & Conditions or other written pre-departure materials.


7. Assumption of Risk


The Guest understands that wildlife travel, safaris, photography expeditions, trekking, and international travel involve inherent risks.


These may include, without limitation, encounters with wild animals; vehicle accidents; rough or remote roads; hiking or trekking over uneven terrain; altitude; adverse weather; illness; food- or water-borne illness; insect bites; infectious diseases; limited or delayed medical care; theft or loss of property; transportation disruptions; acts or omissions of third-party suppliers; political or civil unrest; and natural or human-caused events.


The Guest knowingly and voluntarily assumes the inherent risks associated with participating in the Tour, except to the extent liability cannot lawfully be waived under applicable law.


8. Health, Fitness and Special Requirements


The Guest is responsible for determining whether they are physically and medically capable of participating in the Tour.


Tours may involve long drives, early departures, uneven terrain, high altitude, heat, cold, dust, wildlife proximity, hiking, trekking, boats, remote conditions, or other physical demands.


Guests must disclose before departure any medical condition, allergy, mobility limitation, dietary restriction, medication requirement, or other circumstance that may materially affect participation or require accommodation.


The Tour Host will make reasonable efforts to communicate accommodation requests to applicable suppliers but cannot guarantee that every request can be fulfilled.


Guests are responsible for carrying necessary medications and medical supplies.


9. Emergency Medical Care and Evacuation


If a Guest becomes ill or injured, or if emergency assistance is reasonably believed necessary, the Guest authorizes the Tour Host and applicable third-party providers to arrange medical treatment, transportation, evacuation, hospitalization, or other emergency assistance when reasonably practicable.


The Guest is responsible for costs associated with medical treatment, rescue, evacuation, transportation, hospitalization, or related services.


The Tour Host cannot guarantee the availability, speed, or quality of medical care or evacuation services, particularly in remote locations.


10. Third-Party Suppliers and Local Operators


The Tour Host works with independent local operators, guides, drivers, lodges, camps, transportation providers, activity providers, airlines, and other suppliers in organizing and facilitating Tours.


These providers may be independent contractors and are not necessarily employees of the Tour Host.


Certain components of a Tour may also be subject to the terms, conditions, rules, limitations, or cancellation policies of the applicable local operator or supplier.


To the fullest extent permitted by applicable law, the Tour Host is not responsible for acts, omissions, service failures, delays, cancellations, insolvency, overbooking, injury, loss, or damage attributable to an independent third-party supplier, except to the extent liability cannot lawfully be excluded.


Any specific local operating partner applicable to a Tour may be identified in the Trip-Specific Terms & Conditions.


11. Wildlife Sightings and Photography


Wild animals are unpredictable.


The Tour Host cannot guarantee sightings of any particular species, animal behavior, photographic opportunity, weather condition, lighting condition, or access to any particular location.


Tours are designed to provide strong wildlife-viewing and photographic opportunities, but failure to observe or photograph a particular species, behavior, or scene does not constitute grounds for a refund.


Photography instruction or guidance may be provided as described for the applicable Tour, but no particular photographic result is guaranteed.


12. Itinerary Changes


Wildlife travel frequently requires flexibility.


The Tour Host and applicable local operators may make reasonable changes to accommodations, routes, schedules, guides, transportation, activities, or other itinerary components when necessary or advisable because of weather, wildlife movement, park regulations, safety concerns, supplier availability, transportation issues, operational conditions, or other unforeseen circumstances.


Reasonable itinerary modifications do not constitute a breach of these terms or automatically entitle the Guest to a refund, credit, or price reduction when reasonable efforts are made to provide a substantially comparable experience.


13. Guest Conduct


Guests must behave responsibly and comply with lawful instructions from the Tour Host, guides, drivers, accommodation providers, local operators, and park or wildlife authorities.


The Tour Host may remove a Guest from an activity or Tour if the Guest’s behavior is unsafe, illegal, abusive, seriously disruptive, harmful to wildlife, disrespectful toward local communities or staff, or materially interferes with the safety or experience of others.


Removal for such conduct may occur without refund to the extent permitted by law.


The Guest is responsible for damage they cause to accommodations, vehicles, equipment, property, or other persons and for resulting charges, fines, or penalties.


14. Guest Cancellation


Cancellation policies, including deposit refundability and applicable cancellation deadlines, may vary by Tour and are stated in the applicable Trip-Specific Terms & Conditions.


All cancellations must be submitted in writing and become effective when received by the Tour Host.


Unless otherwise provided in the Trip-Specific Terms & Conditions, no refund, credit, or prorated reimbursement will be provided for unused portions of a Tour resulting from late arrival, early departure, missed flights or transfers, failure to obtain required documentation, or voluntary non-participation.


Guests are strongly encouraged to purchase travel insurance that provides appropriate cancellation and interruption coverage.


15. Cancellation by the Tour Host


The Tour Host may cancel a Tour if minimum participation is not reached, a critical supplier becomes unavailable, or circumstances make operation of the Tour impracticable or unsafe.


If the Tour Host cancels a Tour for reasons other than a force majeure event, amounts paid to the Tour Host for the canceled Tour will be refunded according to the applicable Trip-Specific Terms & Conditions.


Unless otherwise required by law or expressly agreed in writing, the Tour Host is not responsible for independently purchased airfare, additional hotel stays, equipment rentals, visa expenses, vaccinations, missed work, or other incidental or consequential expenses.


16. Force Majeure


The Tour Host shall not be responsible for failure or delay in performing obligations when caused by circumstances beyond reasonable control, including natural disasters, severe weather, floods, fires, epidemics or pandemics, government actions or restrictions, border closures, airline or transportation disruptions, strikes, civil unrest, war, terrorism, crime conditions, park closures, or similar events.


When such circumstances materially affect a Tour, the Tour Host may reasonably modify the itinerary, postpone the Tour, offer a credit, or cancel all or part of the Tour.


If a Tour is canceled because of circumstances beyond the Tour Host’s reasonable control, refunds or credits may be reduced by non-recoverable deposits, permit fees, supplier penalties, processing charges, and other costs already incurred for the affected Guest or Tour, subject to applicable law and the applicable Trip-Specific Terms & Conditions.


17. Limitation of Liability and Release


To the fullest extent permitted by applicable law, the Guest releases the Tour Host from claims, demands, damages, losses, liabilities, costs, and expenses arising from participation in the Tour or from inherent risks of travel, except to the extent liability cannot lawfully be waived or excluded.


Nothing in these General Terms is intended to waive liability that cannot legally be waived.


To the fullest extent permitted by law, the Tour Host’s aggregate liability arising from a Tour shall not exceed the amount actually paid by the Guest to the Tour Host for that Tour.


To the fullest extent permitted by law, the Tour Host shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost enjoyment, lost business opportunities, lost image files, or replacement value of photography equipment.


18. Personal Property and Photography Equipment


Guests are responsible for safeguarding their own luggage, passports, money, cameras, lenses, computers, phones, memory cards, hard drives, drones, and other personal property.


The Tour Host is not responsible for loss, theft, confiscation, delay, corruption, or damage to personal property or digital files except to the extent liability cannot lawfully be excluded.


Guests should obtain appropriate insurance for valuable photography and electronic equipment.


19. Photography, Video and Promotional Use


Guests retain ownership of photographs and other creative work they personally create during a Tour.


The Tour Host may photograph or record Tour activities for documentary, promotional, website, and social-media purposes.


Guests may opt out of identifiable promotional use of their likeness by notifying the Tour Host in writing before departure.


Separate releases may be used when appropriate.


20. Indemnification


To the fullest extent permitted by law, the Guest agrees to indemnify and hold harmless the Tour Host from claims, damages, losses, liabilities, costs, and expenses arising from the Guest’s misconduct, negligence, violation of applicable laws or park regulations, breach of applicable booking terms, or damage caused by the Guest to persons or property.


21. Governing Law and Dispute Resolution


These General Terms shall be governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except where applicable law requires otherwise.


Any legal proceeding arising from these General Terms or a Tour shall be brought in a court of competent jurisdiction as provided by applicable law.


The parties may mutually agree in writing to mediation or another form of alternative dispute resolution.


International Tours and services provided by local operators may additionally be subject to applicable laws and regulations of the countries in which those services are performed.


22. Relationship to Trip-Specific Terms


Each Tour may have separate Trip-Specific Terms & Conditions containing provisions including:


Tour dates and destinations; Tour price; deposit amount; payment schedule; final-payment deadline; single supplement; minimum and maximum group size; cancellation schedule; inclusions and exclusions; accommodations; physical requirements; local operating partners; permits; and other Tour-specific conditions.


Those Trip-Specific Terms form part of the Guest’s booking agreement.


If a Trip-Specific Term directly conflicts with these General Terms, the Trip-Specific Term controls for that Tour.


23. Severability and Waiver


If any provision of these General Terms is determined to be invalid or unenforceable, the remaining provisions shall remain effective to the fullest extent permitted by law.


Failure to enforce any provision on one occasion does not waive the right to enforce that provision in the future.


24. Electronic Acceptance


Electronic acceptance, online acknowledgment, electronic signatures, and electronic records may be used in connection with Tour bookings to the extent permitted by applicable law.


By completing a booking, affirmatively accepting these General Terms during checkout, or submitting payment after being provided access to these Terms, the Guest acknowledges that they have had an opportunity to review them and agrees to be bound by them together with the applicable Trip-Specific Terms & Conditions.
